1. Purpose
These Terms of Service (the "Terms") govern access to and use of the Fama service, available at getfama.app, published by AGdev (a French sole proprietorship), 11 rue de la Présentation, 75011 Paris, SIRET 822 262 531 00020.
Fama is a mobile application (PWA) designed for local independent businesses to manage their Google reviews: notifications, AI-drafted reply suggestions, direct publishing via the Google Business Profile API.
2. Acceptance
Use of the service implies full acceptance of these Terms, of our Privacy policy, and where applicable of the Sales terms.
3. Account creation
Registration is free and uses your Google account. You must:
- Be of legal age or have authorisation from a legal representative
- Be the legitimate owner or manager of the connected locations
- Provide accurate information
- Keep your credentials confidential
You are solely responsible for actions taken from your account. In the event of fraudulent use, please notify us immediately at contact@getfama.app.
4. User obligations
You agree:
- Not to use Fama to publish false information about competitors
- Not to create defamatory, abusive, racist, hateful or unlawful replies
- Not to use the service for locations you are not legitimately responsible for
- To comply with the Google Business Profile API terms of use
- Not to attempt to hack, scrape, overload or misuse the service
5. AI-drafted reply suggestions
Reply suggestions generated by our AI (Anthropic's Claude model) are proposals you can edit before publishing. You remain the author and sole party responsible for replies published on Google. Fama accepts no responsibility for content published under your identity.
6. Service availability
We strive to keep the service available 24/7. However, interruptions may occur for maintenance, updates, or events of force majeure. No guarantee of absolute availability is offered.
The proper functioning of Fama depends on third-party services (Google Business Profile API, iOS/Android push notifications). Any unavailability of these services may affect Fama without our liability being engaged.
7. Intellectual property
Fama and all of its components (code, design, brand, content) are the exclusive property of AGdev. No licence is granted to the user other than personal use of the service within the scope of their subscription.
Reviews published on Google remain the property of their authors. Your business data (locations, replies) remains your property.
8. Limitation of liability
Fama is provided "as is". To the extent permitted by law, AGdev cannot be held liable for:
- The commercial consequences of the content of replies published by the user
- Reviews being removed or modified by Google
- Any drop in ranking of your Google profile
- Indirect damages (loss of revenue, of clientele, etc.)
- Service interruptions linked to third parties (Google, telecom providers)
In any event, AGdev's liability is limited to the amount paid by the user over the last 12 months.
9. Suspension and termination
We may suspend or terminate your account without notice in the event of serious breach of the Terms, including fraudulent use, attempted hacking, or publication of illegal content.
You can cancel your subscription at any time from the app (Settings → Subscription) or by email at contact@getfama.app. Cancellation takes effect at the end of the current billing period.
10. Changes to the Terms
We may modify the Terms at any time. Substantial changes will be notified to you by email at least 30 days before they take effect. If you do not accept these changes, you can cancel your subscription before they take effect.
11. Scope of the service
Fama is exclusively intended for professionals (independent businesses, tradespeople, self-employed professionals, companies) acting within the scope of their business activity. The service is not marketed to consumers. By creating an account, the user acknowledges acting for professional purposes.
12. Applicable law and jurisdiction
These Terms are governed by French law. Any dispute relating to their interpretation or performance, failing amicable resolution, falls under the exclusive jurisdiction of the Tribunal Judiciaire de Paris.
